April 26, 2004 – Semiconductor Manufacturing International Corp. (SMIC) has chalked up the first courtroom victory in the lawsuit brought against the company by Taiwan Semiconductor Manufacturing Co. (TSMC), reported the South China Morning Post. TSMC filed eight causes of action in December, including patent infringement (5) and misappropriation of trade secrets and unfair competition (3). SMIC’s case for dismissal was that the northern California court where the case was filed did not have jurisdiction over the trade secret and competition allegations, which were dismissed without a hearing on April 21.
