Court: IMEC not at fault in Rose suit

July 10, 2007 – A court in Dallas, TX has upheld a jury verdict from earlier this year that European research consortium IMEC is not responsible for financial losses alleged by Rose Research (a Texas company with roots in Belgium) going back to 2003.

In 1998 IMEC granted a license to Rose to commercialize results of a joint research project between IMEC and the Vrije Universiteit Brussel (and Rose would only pay a license fee if the technology was commercialized), but the technology did not gain adoption as was hoped.

The court did note, though, that IMEC “may have been insufficiently clear as to their relation with the VUB,” but this could not have caused damage to Rose shareholders, IMEC explained, in a statement.
