Aug. 13, 2001 – Petaluma, CA – Tegal Corp. said today that an appellate court has affirmed in virtually every respect a judgment entered for Tegal in 1999 against Tokyo Electron Limited for infringing US patent No. 4,464,223.
The US Federal Circuit Court of Appeals sent the case back to US District Court for the Eastern District of Virginia for further fact finding on certain issues concerning a validity defense.
Tegal said it is “confident” that the injunction against TEL and its US subsidiary will be reinstated by the Court in Virginia. The assigned District Court judge in Virginia previously found Tokyo Electron to be a willful infringer.
