Judge tosses all but 3 claims against Infineon

May 1, 2001 – Richmond, VA – The federal judge presiding over the Infineon/Rambus trial tossed out 54 claims brought by Rambus Inc. against Infineon, leaving only three patent infringement claims upon which the case now centers.

US District Judge Robert Payne said Rambus didn’t show why those 54 claims should be considered. One of the 54 claims dismissed includes a key charge of willful infringement against Infineon. Payne is also set to consider motions by Infineon to dismiss the remaining claims, following the filing of briefs by both parties.

Infineon claims that Rambus’ top management continuously took part in discussions concerning how the RDRAM patent could be changed to cover the JEDEC industry SDRAM standard.

Rambus claims Infineon instead took parts of the RDRAM intellectual property for the JEDEC SDRAM standard.

A spokesman for Rambus told Reuters that the three remaining claims were strong. “In a patent infringement lawsuit all you need is one claim and one patent,” the spokesman, Gary Harmon, told Reuters.
