March 8, 2006 – Spansion Inc., the former flash memory JV between AMD and Fujitsu, has filed a trademark infringement lawsuit against Macronix International and Macronix America, alleging the company is falsely claiming to be an authorized second source for Spansion’s MirrorBit flash memory products, and that its products are interchangeable and compatible with MirrorBit products. The suit calls for Macronix to cease-and-desist such claims, “forfeit ill-gotten gains,” and pay over $100 million in damages for misuse of the brand.

“Spansion has invested hundreds of millions of dollars over eight years to develop MirrorBit products,” stated Robert Melendres, EVP and general counsel for Spansion. “By making false statements about Spansion’s MirrorBit brand, and illegally using Spansion’s valuable trademark to market its products, Macronix has diluted our brand and caused confusion in the market place.”
