Caliper, Molecular Devices settle lawsuit

Nov. 5, 2003 — Caliper Technologies Corp. has settled a patent infringement lawsuit it filed last year against Molecular Devices Corp., according to a news release.

As part of the settlement, Molecular Devices has agreed to pay Caliper a one-time licensing fee as well as royalties based on future sales of its IMAP assay products. Financial details were not disclosed.

The lawsuit alleged that Molecular Devices IMAP products infringed Caliper’s U.S. patent 6,287,774 for “Assay Methods and Systems.” Microfluidic assay methods, used to screen molecules, are used in the drug development process.

Hopkinton, Mass.-based Caliper, listed on Nasdaq, closed Tuesday at 5.50, down from 5.66 Monday. Sunnyvale, Calif.-based Molecular, also listed on Nasdaq, closed Tuesday at 18.84, up from 18.35 Monday.
