December 3, 2007 — /PRNewswire/ — MILPITAS, CA — Celerity, Inc., a technology leader in precision instruments and advanced gas and liquid delivery solutions for the global semiconductor and electronics industries, announced today the U.S. District Court for the Northern District of California issued a permanent injunction in Celerity’s patent infringement suit against Ultra Clean Holdings, Inc., and its subsidiary Ultra Clean Technology Systems and Service, Inc., Menlo Park, CA (“UCT”). The court’s order prohibits UCT from manufacturing, selling, and importing any Predator or “colorably similar” products into the United States.

In June, a unanimous jury validated Celerity’s U.S. Patent Nos. 6,435,215 and 6,394,138, and found that UCT’s Predator product infringed on Celerity’s patented modular gas delivery technology used in semiconductor manufacturing and other related industries requiring high-precision process control.

In addition to the permanent injunction, the court ordered that UCT pay Celerity royalties for past infringing sales by the Predator product, plus interest, as well as for costs incurred while prosecuting this action.

“This is a landmark victory for us as it validates Celerity’s strategy to invest in developing advanced modular substrate technology supporting our customer’s next generation semiconductor manufacturing solutions,” says David Somo, senior vice president of sales and marketing at Celerity.

December 3, 2007 — /PRNewswire/ — MENLO PARK, CA — Ultra Clean Holdings, Inc., the parent company of Ultra Clean Technology Systems and Service, Inc. (UCT), a leading developer and supplier of critical subsystems for the semiconductor capital equipment industry, announced today that an injunction has been entered by the court with respect to patent infringement claims brought against UCT by Celerity, Inc., requiring it to cease the manufacturing and sale of its Predator(TM) product. In addition, the court entered a judgment awarding Celerity reasonable royalty damages and pre-judgment interest ($13,900.00 and $523.91 respectively through June 2007), as well as Celerity’s costs in the litigation, which the company does not expect to be material. The judgment is not expected to have a material adverse effect on UCT’s operating results or financial condition.

This judgment follows the jury’s verdict in June 2007 finding that UCT infringed one of the two patents at issue in the trial, but did not infringe the other. Prior to the trial, UCT had been granted summary judgment of non-infringement of four of Celerity’s patents, and Celerity had voluntarily dismissed other asserted claims. In addition, the U.S. Patent Office has already granted UCT’s request to reexamine the patent at issue based on substantial new questions of patentability raised by prior art not considered by the Patent Office during the initial examination of the patent.

Innotech Products is a complete source for motorized and terminal ceiling filters. The company’s 112-424 HEPA filtered recirculation system will create a positive-pressure cleanroom in new or existing spaces. The self-contained filter draws air in through a top-mounted pre-filter, then blows the air out the other side through a HEPA filter (ULPA filters available) into a controlled space. This model can be installed into a 2×4 ft ceiling grid system, mounted on support frames, or suspended from support structures. Innotech’s recirculating 112-424AR HEPA filter system with an air return grill offers an easy and low-cost solution for retrofitting existing rooms into cleanroom spaces. The “closed-loop” airflow system eliminates the concern of drawing in air from a drop-ceiling, which can be too warm or too cold for comfort. A “T” fitting can be installed onto the blower inlet. One leg connects to the pre-filter return; the other connects to the HVAC system. As the thermostat calls for heating or cooling, the air flows through the HEPA filter and into the cleanroom. The unit is UL Listed, USP <797> compliant, and draws only 3.5 A at 115 V. To speak to a cleanroom specialist regarding these and other cleanroom needs, call 888-270-0458 or e-mail [email protected].
